Terms of Service

Summary
Use lynko.my responsibly. You own your content. We protect the service and our users.
No illegal content, phishing, malware, or scams.
No attempts to bypass security, abuse limits, or scrape the platform.
We may suspend accounts/pages/domains to protect users and the service.

âš ī¸ Binding Agreement

By creating an account, accessing lynko.my, or using any of our services, you agree to be legally bound by these Terms of Service. If you do not agree, you must immediately stop using lynko.my and delete your account.

1. Definitions

  • "Service" or "Platform" means lynko.my, including the website, dashboard, API, public pages, short links, and all related features.
  • "You" or "User" means any individual or entity that creates an account or accesses lynko.my.
  • "We" or "lynko.my" means the operators of the lynko.my platform and service.
  • "Content" means any text, images, videos, links, domains, or other materials you upload or configure on lynko.my.
  • "Account" means your registered user profile, accessible via email/OTP or Telegram authentication.

2. Eligibility & Account Creation

2.1 Age Requirements

You must be at least 13 years old (or 16 in the EU/EEA) to use lynko.my. If you are under 18, you confirm that you have parental or guardian consent to use the service.

2.2 Account Registration

  • You must provide accurate and complete information when creating an account (email or Telegram profile).
  • You are responsible for maintaining the security of your account. Do not share your login credentials or one-time codes with anyone.
  • If you suspect unauthorized access, contact hello@lynko.my immediately.
  • You may only create one account per person/entity unless explicitly authorized by us.

2.3 Username & Public Pages

  • Your username (e.g., lynko.my/yourname) must be unique and cannot infringe on trademarks, impersonate others, or violate our Acceptable Use Policy.
  • We reserve the right to reclaim or suspend usernames that violate these rules, are inactive for extended periods, or are needed for official lynko.my purposes.

3. Acceptable Use Policy

🚨 Zero Tolerance for Abuse

Violating the Acceptable Use Policy may result in immediate account suspension, content removal, domain blocking, and/or reporting to law enforcement without prior notice.

3.1 Prohibited Content & Activities

You may NOT use lynko.my to:

  • Illegal activities: Violate any local, national, or international law (including copyright, trademark, obscenity, and export control laws)
  • Malware & phishing: Distribute viruses, ransomware, trojans, keyloggers, or deceptive login pages designed to steal credentials
  • Scams & fraud: Run pyramid schemes, fake giveaways, cryptocurrency scams, fake investment schemes, or fraudulent e-commerce
  • Spam: Send unsolicited bulk messages, automate account creation, or use lynko.my for email/SMS spam campaigns
  • Harassment & hate speech: Publish content that harasses, threatens, doxes, or incites violence against individuals or groups based on race, religion, gender, sexual orientation, disability, or nationality
  • CSAM & exploitation: Post, link to, or distribute child sexual abuse material (CSAM) or content that exploits minors. This is a criminal offense and will be reported to NCMEC/law enforcement immediately.
  • Trademark/brand abuse: Impersonate brands, companies, or public figures to deceive users (e.g., fake Nike pages, fake Apple support links)
  • Adult content (restricted): Explicit pornography, escort services, or adult content that violates payment processor policies (if using paid plans). Legal adult content for personal pages may be allowed on free plans but must comply with age verification laws and not violate other rules.
  • Illegal goods: Sell drugs, weapons, counterfeit goods, stolen credit cards, or other illegal products/services
  • Evasion tactics: Use cloaking, redirects, or obfuscation to hide prohibited content from our moderation systems

3.2 Technical Abuse

You may NOT:

  • Bypass rate limits: Use multiple accounts, proxies, or automation to exceed usage quotas
  • Scraping/crawling: Use bots, scrapers, or automated tools to extract data from lynko.my (except with written permission)
  • DDoS/attacks: Attempt to overload, crash, or exploit vulnerabilities in lynko.my infrastructure
  • Reverse engineering: Decompile, disassemble, or attempt to extract source code from our platform (except where allowed by law for security research — please report vulnerabilities responsibly)
  • Unauthorized access: Access other users' accounts, admin panels, or private data without authorization

3.3 Domain-Specific Rules

If you connect a custom domain:

  • You must own or have legal rights to use that domain
  • Domains used for phishing, malware distribution, or brand impersonation will be blocked immediately
  • We may block domains at the request of trademark holders, law enforcement, or abuse reports (see our Privacy Policy for details)
  • Domains must comply with DNS verification (A/AAAA or CNAME records pointing to lynko.my)

4. Content Ownership & Licenses

4.1 Your Content

You own all content you create on lynko.my (pages, links, images, text, etc.). By uploading content, you grant lynko.my a limited, non-exclusive, worldwide license to:

  • Host and display your content on your public page
  • Serve your content via CDN/hosting infrastructure
  • Create backups for disaster recovery
  • Generate thumbnails/previews for your media

This license ends when you delete your content or account (subject to backup retention periods in our Privacy Policy).

4.2 Copyright & DMCA

If you believe content on lynko.my infringes your copyright, you may submit a DMCA takedown notice to hello@lynko.my with:

  • Your contact information (name, email, address)
  • Identification of the copyrighted work
  • URL of the infringing content on lynko.my
  • A statement that you have a good-faith belief the use is unauthorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

Repeat copyright infringers will have their accounts terminated.

4.3 Trademark Claims

If you are a trademark holder and believe a lynko.my user is infringing your trademark (e.g., impersonation, counterfeit sales), contact us at hello@lynko.my with:

  • Proof of trademark ownership (registration number)
  • URL of the infringing page/domain
  • Explanation of how the use is infringing (e.g., customer confusion, unauthorized resale)

4.4 User-Uploaded Media

You represent and warrant that:

  • You own or have licenses for all images, videos, and files you upload
  • Your content does not violate third-party rights (privacy, publicity, copyright, trademark)
  • You will not upload sensitive personal information (social security numbers, credit card numbers, private medical records) to public pages

5. Billing, Payments & Refunds

5.1 Free Plan

lynko.my offers a free plan with limited features (see dashboard for current limits: pages, domains, short links, analytics retention). Free accounts are subject to these Terms and may be suspended for abuse.

5.2 Paid Plans

Paid plans offer higher limits and additional features. Current pricing is displayed in the dashboard (Billing section). By purchasing a paid plan:

  • You authorize lynko.my to charge your payment method (card via Stripe, or cryptocurrency via NOWPayments)
  • Subscriptions renew automatically unless canceled
  • You are responsible for keeping your payment method current

5.3 Payment Processors

We use third-party payment processors:

  • Stripe: for credit/debit card payments (subject to Stripe's Terms of Service)
  • NOWPayments: for cryptocurrency payments (subject to NOWPayments' Terms)

Payment disputes should be directed to the relevant processor. We do not store full card numbers or crypto private keys.

5.4 Pricing Changes

We may change pricing at any time. If your plan price increases:

  • You will be notified 30 days in advance via email and dashboard notice
  • The new price applies at your next renewal
  • You may cancel before renewal to avoid the new price

Continued use after a price change constitutes acceptance.

5.5 Refunds

Refunds are generally not provided due to the immediate provisioning of services. Exceptions:

  • Accidental double charges: We will refund duplicate transactions
  • Service outages: If lynko.my is unavailable for >72 consecutive hours (excluding scheduled maintenance), you may request a pro-rated refund
  • Account suspension for our error: If we incorrectly suspend your account and you lost paid service time, we will credit or refund the lost period

Refund requests must be submitted within 30 days of the charge to hello@lynko.my.

5.6 Cancellation

You may cancel your paid plan at any time (Dashboard → Billing → Cancel). Upon cancellation:

  • You retain access until the end of your current billing period
  • No refund is issued for unused time
  • Your account reverts to the free plan (content exceeding free limits may be disabled)

5.7 Taxes

Prices do not include taxes (VAT, GST, sales tax). You are responsible for all applicable taxes based on your billing address. We may collect and remit taxes where required by law.

6. Service Availability & Limitations

6.1 "As-Is" Service

lynko.my is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Guarantees of uptime, performance, or error-free operation
  • Guarantees that the service will meet your specific requirements

6.2 Maintenance & Downtime

We may:

  • Perform scheduled maintenance (we will provide advance notice when possible)
  • Experience unplanned downtime due to server issues, DDoS attacks, or infrastructure failures
  • Temporarily disable features for security updates or bug fixes

We are not liable for downtime or service interruptions.

6.3 Changes to Features

We may, at any time and without notice:

  • Add, modify, or remove features
  • Change API endpoints or data formats
  • Adjust usage limits (pages, domains, short links, analytics)
  • Deprecate or discontinue parts of the service

We will make reasonable efforts to provide advance notice for breaking changes.

6.4 Third-Party Services

lynko.my integrates with third-party services (Stripe, NOWPayments, Telegram, Let's Encrypt, etc.). We are not responsible for:

  • Outages or failures of third-party services
  • Changes to third-party APIs or policies
  • Data loss or security breaches at third-party providers (though we will notify you if we become aware of any)

7. Account Suspension & Termination

7.1 Our Right to Suspend/Terminate

We may immediately suspend or terminate your account, pages, domains, or short links without prior notice if:

  • You violate these Terms of Service or our Acceptable Use Policy
  • We receive a valid legal request (court order, law enforcement subpoena)
  • We receive a credible abuse report (phishing, malware, trademark infringement)
  • Your account is used for automated abuse, spam, or scraping
  • Your payment fails or is disputed (chargebacks)
  • We determine, in our sole discretion, that your use poses a risk to lynko.my, our users, or our infrastructure

7.2 Domain Blocking

Admins may block custom domains (separate from account suspension) if:

  • The domain is used for abuse (phishing, malware, spam)
  • A trademark holder files a valid complaint
  • Law enforcement requests blocking

Blocked domains are removed from lynko.my DNS/SSL provisioning and cannot be used for pages or short links.

7.3 Appeals

If your account/domain is suspended and you believe it was in error, contact hello@lynko.my with:

  • Your username and account details
  • Explanation of why the suspension is incorrect
  • Evidence supporting your case (screenshots, links, etc.)

We will review appeals within 7 business days. Our decision is final.

7.4 Your Right to Terminate

You may delete your account at any time (Dashboard → Settings → Delete Account). Upon deletion:

  • Your pages, links, and domains are removed
  • Personal data is deleted within 30 days (see Privacy Policy)
  • Billing subscriptions are canceled (no refunds for unused time)

Account deletion is permanent and cannot be undone.

7.5 Effect of Termination

Upon termination (by you or us):

  • Your public pages become inaccessible (404 errors)
  • Short links stop redirecting
  • Custom domains lose SSL certificates and DNS routing
  • All clauses of these Terms that should survive (Indemnity, Limitation of Liability, Arbitration) remain in effect

8. Liability & Indemnification

8.1 Limitation of Liability

🔴 CRITICAL: READ CAREFULLY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LYNKO.MY (AND ITS OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES) SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages (including lost profits, data loss, business interruption, or reputational harm)
  • Damages arising from: (a) your use or inability to use the service, (b) unauthorized access to your account, (c) third-party content or conduct, (d) errors or interruptions in service, (e) viruses or malware, (f) loss of data
  • Damages exceeding the amount you paid lynko.my in the 12 months preceding the claim (if you use the free plan, this is $0 USD)

This limitation applies even if lynko.my was advised of the possibility of such damages.

8.2 Indemnification

You agree to indemnify, defend, and hold harmless lynko.my (and its operators, employees, contractors, and affiliates) from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from:

  • Your violation of these Terms or the Acceptable Use Policy
  • Your content (pages, links, domains, uploads) infringing third-party rights
  • Your use of lynko.my to engage in illegal activity
  • Claims by third parties related to your lynko.my pages (e.g., defamation, copyright infringement, trademark disputes)

8.3 Third-Party Claims

If a third party sues lynko.my because of your content or conduct, you will:

  • Cooperate with our defense
  • Pay all costs, settlements, and judgments
  • Not settle any claim without our prior written consent

9. Dispute Resolution & Arbitration

â„šī¸ Binding Arbitration

Most disputes must be resolved through binding arbitration instead of court litigation. Please read this section carefully.

9.1 Informal Resolution

Before filing any legal claim, you must first contact hello@lynko.my and attempt to resolve the dispute informally for at least 30 days.

9.2 Binding Arbitration

If informal resolution fails, you agree that any disputes will be resolved by binding arbitration (not in court), except:

  • Small claims court cases (if they qualify)
  • Intellectual property disputes (copyright, trademark)
  • Claims for injunctive relief (e.g., to stop ongoing abuse)

Arbitration will be conducted under internationally recognized arbitration rules, with proceedings held in English. The arbitration shall be conducted online or at a mutually agreed neutral location.

9.3 Class Action Waiver

You waive your right to participate in class action lawsuits, class arbitrations, or representative actions. All claims must be brought individually.

9.4 Governing Law

These Terms are governed by principles of international commercial law and the laws applicable in the jurisdiction where the service is operated. Any disputes not resolved through arbitration will be subject to the jurisdiction of courts competent to hear such disputes.

10. Miscellaneous

10.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and lynko.my. They supersede all prior agreements, understandings, and representations.

10.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.

10.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

10.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to any successor entity (e.g., in a merger or acquisition).

10.5 Force Majeure

We are not liable for failures or delays caused by events beyond our reasonable control (natural disasters, wars, pandemics, internet outages, government actions, DDoS attacks).

10.6 Export Compliance

You may not use lynko.my in violation of export control laws (U.S. OFAC sanctions, EU embargoes, etc.). You represent that you are not on any government prohibited party list.

10.7 Survival

Sections that should survive termination (Ownership, Liability, Indemnification, Arbitration, Governing Law) remain in effect after these Terms end.

11. Changes to These Terms

We may update these Terms at any time to reflect:

  • New features or services
  • Changes in legal requirements
  • Updates to our policies or infrastructure

The "Last updated" date at the top will reflect the latest version. If we make material changes, we will notify you via:

  • A notice in your dashboard
  • Email (if you have provided one)
  • A prominent banner on lynko.my for 30 days

âš ī¸ Acceptance Required

Your continued use of lynko.my after changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the service and delete your account.
